If you’re breeding dogs in the UK, it’s worth understanding when a licence is legally required, since the rules apply more widely than many people expect. Under the Animal Welfare (Licensing of Activities Involving Animals) Regulations 2018, a breeding licence is needed if you breed three or more litters of puppies in any 12-month period, or if you breed dogs and advertise a business of selling them, regardless of how many litters that involves.

Local authorities assess whether a breeder is ‘advertising a business’ by looking at factors like the number, frequency and volume of sales, and whether animals are being sold at a scale or profit margin consistent with trading rather than a one-off litter. This means even a smaller-scale breeder can fall under licensing requirements if they’re clearly operating as a business.

Licensed premises must meet welfare standards covering areas such as suitable housing, transport, and record-keeping, with inspections carried out by the local authority, often alongside a vet. Breeders who meet higher welfare standards can qualify for a longer licence term and a reduced fee, rewarding good practice with less administrative burden.

Lucy’s Law, introduced in 2020, added a further restriction by banning the third-party sale of puppies and kittens in England, meaning anyone looking to buy or rehome a puppy must now deal directly with the breeder or an approved rescue centre rather than a pet shop or dealer.

Penalties for breeding without a required licence can be significant, including unlimited fines and, in serious cases, imprisonment or disqualification from keeping animals. Given how the rules are enforced, it’s always worth checking your specific obligations with your local authority rather than assuming a small-scale operation falls outside the licensing requirements.
